# Sublease agreement template

A rental contract allowing tenants (sublessors) to rent their leased apartment or house to subtenants (sublessees). Covers sublease term, monthly rent, security deposits, utilities, landlord consent requirements, master lease obligations, sublessee responsibilities, and termination conditions.

## Sublease Agreement

This Sublease Agreement (the "Sublease") is entered into on 2024-01-01 (the "Effective Date") by and between Sublessor Name ("Sublessor") with an address of Sublessor Address and Sublessee Name ("Sublessee") with an address of Sublessee Address.

### 1. Subleased Premises

### 4. Rent and Payment

Late Fee: $50 if rent not received by 5 days after due date

### 5. Security Deposit

- Damage beyond normal wear and tear

### 7. Additional Fees and Charges

### 8. Use of Premises

Permitted Use: Residential use only

Occupants: Only the following persons may occupy the premises:

- occupant 2 name
- additional occupants

Guests: guest policy (short-term guests allowed for up to guest max days days)

No Subletting: Sublessee may NOT further sublet or assign without written consent of both Sublessor and Landlord

Business Use: business use prohibition (prohibited / limited home office allowed)

Smoking: smoking policy (prohibited / allowed in designated areas)

Pets: pet policy

Approved Pets: approved pets

### 9. Condition and Maintenance

Condition at Move-In: Premises delivered in: move in condition

Move-In Inspection: Checklist completed on move in inspection and attached as Exhibit C

Sublessee Maintenance Responsibilities:

- Keep premises clean and sanitary
- Dispose of trash properly
- Replace light bulbs and batteries
- Minor repairs under minor repair threshold
- HVAC filter changes: filter responsibility
- Report maintenance issues promptly
- Prevent frozen pipes and other preventable damage
- additional sublessee maintenance

Sublessor/Landlord Maintenance Responsibilities:

- Structural repairs
- Major systems (HVAC, plumbing, electrical)
- Appliance repairs/replacement
- Roof, foundation, exterior
- landlord maintenance items

Maintenance Requests: Sublessee shall report issues to: maintenance contact within maintenance reporting days days of discovery

Emergency Repairs: For emergencies (water leaks, no heat, etc.), Sublessee should:

1. Contact: emergency contact
2. Take reasonable steps to prevent further damage
3. Document with photos

### 10. Alterations and Improvements

Prohibited Without Consent: Sublessee may not make alterations, improvements, or changes without written consent of both Sublessor and Landlord

Prohibited Actions:

- Painting walls
- Installing fixtures
- Changing locks
- Mounting items causing significant damage
- Structural changes
- additional prohibited alterations

Permitted Alterations: permitted alterations (e.g., removable hooks, temporary window treatments)

Restoration: Any alterations must be reversed and premises restored to original condition at Sublessee's expense upon move-out, unless otherwise agreed

### 11. Rules and Regulations

Building/Complex Rules: Sublessee agrees to comply with all building, HOA, or complex rules including: building rules

Quiet Hours: quiet hours

Common Area Use: common area rules

Parking Rules: parking rules

Pool/Amenity Rules: amenity rules

Master Lease Compliance: Sublessee must comply with all provisions of the Master Lease as if Sublessee were the tenant

### 12. Sublessor's Obligations

Sublessor agrees to:

- Maintain Master Lease in good standing
- Pay Master Lease rent to Landlord timely
- Not violate Master Lease terms
- Forward Sublessee's maintenance requests to Landlord
- Provide Sublessee with copy of Master Lease and building rules
- Not interfere with Sublessee's quiet enjoyment
- Notify Sublessee of any Master Lease violations or issues

Sublessor Remains Liable: Sublessor remains fully liable to Landlord for all Master Lease obligations

### 13. Sublessee's Obligations

Sublessee agrees to:

- Pay rent timely
- Maintain premises in good condition
- Comply with Master Lease, building rules, and this Sublease
- Not disturb other tenants
- Properly use all appliances and systems
- Keep premises secure (lock doors/windows)
- Maintain renter's insurance: renters insurance requirement
- Notify Sublessor of any issues or violations
- Allow access for inspections and repairs
- Indemnify Sublessor for damage or violations caused by Sublessee

### 14. Access and Entry

Sublessor Access: Sublessor may enter premises:

- With access notice hours hours notice (except emergencies)
- For inspections, maintenance, or showing to prospective tenants
- In emergencies without notice
- At reasonable times: access hours

Landlord Access: Landlord retains all access rights per Master Lease

Sublessee Cooperation: Sublessee shall accommodate reasonable access requests

### 15. Insurance and Liability

Renter's Insurance: Sublessee insurance requirement (required / strongly recommended) to maintain renter's insurance with minimum coverage: minimum coverage

Sublessee's Property: Sublessor and Landlord not liable for damage to or loss of Sublessee's personal property

Liability for Damage: Sublessee liable for damage to premises caused by Sublessee, guests, or pets beyond normal wear and tear

Indemnification: Sublessee agrees to indemnify and hold harmless Sublessor and Landlord from claims arising from Sublessee's use of premises

### 16. Default and Remedies

Events of Default:

- Failure to pay rent when due
- Violation of Sublease terms
- Violation of Master Lease terms
- Abandonment of premises
- Unauthorized occupants or subletting
- Damage to property
- Illegal activity

Notice and Cure: Sublessor shall provide cure period days days written notice to cure (except for non-payment or illegal activity which may be less per local law)

Remedies: Upon default, Sublessor may:

- Terminate Sublease
- Retain security deposit
- Pursue legal action for damages
- Evict per local law
- Pursue other remedies available under law

Holdover: If Sublessee remains after termination without consent: holdover terms

### 17. Termination

Natural Expiration: Sublease automatically terminates on expiration date

Early Termination by Sublessee: early termination by sublessee (allowed with early termination notice days notice and fee of early termination fee / not allowed)

Early Termination by Sublessor: Sublessor may terminate if:

- Master Lease terminates
- Sublessor needs to reoccupy
- Sublessee defaults

Notice: sublessor termination notice days (unless default)

Master Lease Termination: If Master Lease terminates for any reason, this Sublease automatically terminates

Military Clause: military clause (if applicable)

Move-Out Requirements: Upon termination, Sublessee shall:

- Vacate premises completely
- Remove all personal property
- Clean premises thoroughly: cleaning requirements
- Return all keys, fobs, remotes
- Forward mail/deliveries
- Restore any alterations
- Complete move-out inspection

### 18. Notices

Notice Requirements: All notices must be in writing and sent to:

### 19. Landlord's Rights

Landlord Not a Party: Landlord is not a party to this Sublease

Direct Enforcement: Landlord may enforce Master Lease terms directly against Sublessee

No Waiver: Landlord's consent to sublease does not waive any Master Lease rights

Sublessee's Status: Sublessee is not a tenant of Landlord unless Landlord explicitly agrees otherwise

### 20. Miscellaneous

Entire Agreement: This Sublease, Master Lease, and exhibits constitute entire agreement

Amendments: Must be in writing signed by both parties and approved by Landlord if required

Severability: Invalid provisions don't affect remaining terms

Governing Law: Laws of governing jurisdiction

Dispute Resolution: dispute resolution (mediation / arbitration / litigation)

Attorney Fees: Prevailing party in legal action entitled to reasonable attorney fees

Waiver: Failure to enforce any provision doesn't waive future enforcement

Binding Effect: Binds and benefits parties and permitted successors

Headings: For convenience only

No Agency: Sublessor and Sublessee are not partners, joint venturers, or agents

Joint and Several: If multiple Sublessees, all are jointly and severally liable

Time is of the Essence: Deadlines are strict

### 21. Disclosures

Lead Paint: (if built before 1978) lead paint disclosure

Mold: mold disclosure

Bed Bugs: bed bug disclosure

Other Disclosures: additional disclosures

As-Is Condition: Sublessee accepts premises in current condition except as noted in move-in inspection

### 22. Acknowledgments

Sublessee Acknowledges:

- Receiving copy of Master Lease and building rules
- Understanding Sublease terminates if Master Lease terminates
- Understanding Sublessor remains liable under Master Lease
- Landlord consent obtained: Yes
- Inspecting premises and finding acceptable
- No representations made except those in writing

Sublessor Acknowledges:

- Master Lease permits subletting with landlord consent
- Obtaining landlord consent before sublease begins
- Remaining liable to Landlord for Master Lease obligations
- Current on all Master Lease obligations
