Reminder guidance for this contract type
Trademarks need maintenance before they need renewal
A trademark registration is not a one-and-done filing. In the US, the registration only survives if you file a §8 declaration of continued use between the fifth and sixth year, then a combined §8/§9 renewal every ten years after that, each requiring a current specimen showing the mark in commerce. The EU and other systems run their own renewal clocks. Miss the mid-cycle declaration and the registration can be cancelled long before the headline 10-year date you were watching. Tracking the declaration window separately from the renewal is what keeps a mark alive.
A cancelled mark weakens everything built on it
Brand protection compounds: the registration backs enforcement against copycats, supports domain and marketplace disputes, and underpins licensing revenue. When a registration lapses on a missed declaration, that foundation cracks, enforcement gets harder, licensees may have grounds to renegotiate, and re-registering means starting the priority clock over while competitors move in. The maintenance fees are minor; the loss of a registered mark is not. Treating each maintenance window as an owned, recurring reminder protects the brand equity the registration represents.
