Photography Contract

This Photography Contract (the "Agreement") is entered into on 2024-01-01 (the "Effective Date") by and between Client Name ("Client") with an address of Client Address and Photographer Name ("Photographer") with an address of Photographer Address.

1. Event/Session Details

Event/Session Type: Wedding (wedding, portrait session, corporate event, product photography, headshots, family photos, etc.)

Event Date: 2024-06-01

Backup Date: 2024-06-02 (if applicable for weather-dependent shoots)

Event Location(s):

  • Primary Location: Venue Name
  • Secondary Location: Park Name (if applicable)
  • Address: 123 Venue St

Event Start Time: 2:00 PM

Photography Coverage: 1:00 PM to 9:00 PM

Total Hours of Coverage: 8 hours

Additional Hours: Available at $200 per hour

Key Moments/Shots: First Kiss, Cake Cutting

2. Photography Services Included

Coverage Includes:

  • Pre-event consultation: 1 Hour Zoom Call
  • Arrival time: 30 minutes before coverage start
  • Continuous coverage for contracted hours
  • Shot list review and coordination
  • Direction and posing guidance
  • Backup equipment on-site
  • Engagement Session

Photography Style: Candid (candid, posed, photojournalistic, artistic, traditional, etc.)

Second Photographer: Included (included / available for additional $500 / not available)

Assistant: Yes

Special Equipment: Drone (drone, photo booth, lighting setup, etc.)

3. Deliverables and Final Product

Edited Photos: Photographer will deliver approximately 500-800 professionally edited high-resolution digital images

Editing Style: Natural (color correction, retouching, black & white conversions, artistic editing, etc.)

File Format: JPG (JPG, PNG, RAW, etc.)

Resolution: 300 DPI (high-resolution suitable for printing)

Delivery Method: Online Gallery (online gallery, USB drive, cloud download, etc.)

Gallery Access: Pixieset (password-protected online gallery for 365 days)

Download Rights: Unlimited (unlimited downloads / limited time)

Delivery Timeline: 6 weeks from event date

Rush Delivery: Available for additional $300 to deliver within 2 weeks

Sneak Peek: 20 preview images delivered within 3 days

5. Pricing and Payment

Total Photography Fee: $3000

  • 8 hours of coverage

Retainer/Deposit: retainer amount due upon signing to reserve date

Retainer Purpose: Reserves date exclusively for Client; non-refundable if Client cancels

Remaining Balance: remaining balance

Payment Schedule:

  • Upon Signing: deposit amount
  • second payment days days before event: second payment
  • Day of event/session: final payment (if applicable)

Payment Methods: payment methods (credit card, check, bank transfer, PayPal, etc.)

Late Payment: Final images not released until full payment received

Travel Fee: travel fee (included within travel radius miles / travel fee amount beyond radius)

Parking/Venue Fees: parking fees responsibility

6. Client Responsibilities

Client agrees to:

  • Provide accurate event details and timeline
  • Inform Photographer of key family members/VIPs for formal photos
  • Designate a point person for day-of coordination: coordinator name
  • Provide Photographer with vendor meal during events over meal threshold hours hours
  • Ensure Photographer has access to all event areas
  • Inform Photographer of any restrictions (religious, cultural, venue rules)
  • Provide shot list or must-have photos: shot list
  • Obtain necessary permissions for private property/venues
  • additional client responsibilities

Family Photos: Client will organize family members for formal group shots to minimize time

Timeline Coordination: Client provides detailed event timeline by timeline deadline

Copyright Ownership: Photographer retains full copyright to all images

License Granted to Client: Client receives non-exclusive license to:

  • Use images for personal purposes
  • Share on social media with credit to Photographer
  • Print for personal use
  • Display in home
  • additional permitted uses

License Restrictions: Client may NOT:

  • Sell or license images
  • Use images for commercial purposes without written permission
  • Alter images without permission (except cropping for personal use)
  • Remove Photographer's watermark or metadata
  • Claim copyright or ownership

Commercial Use: Requires separate licensing agreement and fee: commercial license fee

Model Release: Client grants Photographer permission to use images for:

  • Photographer's portfolio and website
  • Social media promotion
  • Marketing materials
  • Photography competitions and publications
  • Blog posts

Client may opt out: model release opt out

Credit Requirement: When sharing online, Client should credit: photographer credit (e.g., @PhotographerName or website)

8. Cancellation and Rescheduling

Cancellation by Client:

  • More than cancellation notice days days before event: early cancel refund (retainer forfeited, remaining balance refunded)
  • late cancel threshold-cancellation notice days days: mid cancel refund% refund
  • Less than late cancel threshold days: late cancel terms (no refund, full payment due)

Rescheduling by Client:

  • First reschedule with reschedule notice days+ days notice: no fee
  • Subsequent reschedules: reschedule fee
  • Reschedules within late reschedule days days: late reschedule fee

Cancellation by Photographer: If Photographer cancels (illness, emergency), Client receives full refund. Photographer will attempt to provide qualified substitute photographer. If substitute unacceptable and date cannot be rescheduled, full refund provided.

Weather Cancellations: For outdoor shoots, if weather is unsuitable, session rescheduled to mutually agreeable date at no charge

Acts of God/Force Majeure: Neither party liable for cancellation due to circumstances beyond control (natural disasters, pandemic restrictions, venue closure, etc.). Retainer may be applied to rescheduled date.

9. Post-Production and Editing

Editing Included:

  • Color correction
  • Exposure adjustment
  • Cropping and straightening
  • Light skin retouching (blemish removal)
  • Black & white conversions: bw image count images

Editing Style: Photographer's artistic style and discretion

Image Selection: Photographer selects images for editing based on quality, lighting, focus, and artistic merit

Outtakes: Unflattering, duplicate, or technically flawed images not provided

Client Selection: client selection (Photographer selects all / Client may request specific images from proof gallery)

Additional Editing: Extensive retouching (skin smoothing, body contouring, background changes) available at advanced editing rate per image

10. Backup and Equipment Failure

Backup Equipment: Photographer brings backup cameras and equipment to all shoots

Backup Storage: Images backed up to multiple devices immediately

Equipment Failure: While unlikely, if catastrophic equipment failure prevents completion of shoot, Client receives full refund or complimentary reshoot (if event allows)

Digital Backup: Photographer maintains backups for backup retention months months after delivery

Client Backup Responsibility: After delivery, Client responsible for backing up images. Photographer not liable for Client's data loss.

11. Limit of Liability

Photographer's Liability: Photographer's liability limited to refund of fees paid. Photographer not liable for:

  • Missed shots due to Client not providing timeline/shot list
  • Vendor or family member interference
  • Venues restricting access or positioning
  • Lighting conditions beyond Photographer's control
  • Late start times or schedule delays

No Guarantees: While Photographer will make every effort to capture desired shots, specific moments cannot be guaranteed (e.g., bouquet toss, kiss, etc.)

Venue/Third-Party Restrictions: Photographer not liable for restrictions imposed by venue, officiant, or coordinators

Maximum Liability: In no event shall Photographer's liability exceed total amount paid by Client

12. Model Release and Privacy

Client Grants Permission: For Photographer to use images for promotional purposes (unless opt-out below)

Opt-Out Option: privacy opt out (Client may request images not be shared publicly)

Guest Privacy: Client responsible for informing guests that professional photography is taking place

Sensitive Images: Photographer will use discretion with sensitive moments and obtain permission before public sharing

13. Cooperation and Conduct

Professional Conduct: Photographer will conduct themselves professionally and respectfully

Cooperation: Client, family, and guests will treat Photographer with respect and cooperation

Interference: Unplugged ceremony requests honored: unplugged ceremony

Guest Photographers: Client will ensure guests do not interfere with Photographer's work

Alcohol/Substances: Photographer will not be under influence; same expected of Client and those being photographed during formal sessions

14. Permits and Restrictions

Location Permits: permit responsibility responsible for obtaining permits for public locations

Venue Rules: Photographer will comply with venue restrictions; Client must inform Photographer of any rules

Flash Photography: flash restrictions

Ceremony Restrictions: ceremony restrictions

15. Prints and Color Accuracy

Color Disclaimer: Colors may vary based on monitor calibration and printing methods

Print Lab Recommendation: recommended lab

Print Responsibility: Client responsible for print quality when using third-party labs

Professional Printing: Available through Photographer: print service available

16. Entire Agreement and Modifications

Entire Agreement: This Agreement constitutes entire understanding and supersedes all prior agreements

Amendments: Must be in writing signed by both parties

Severability: Invalid provisions don't affect remaining terms

17. Dispute Resolution

Governing Law: Laws of State of California

Dispute Resolution: Mediation (mediation / arbitration / litigation)

Attorney Fees: Prevailing party entitled to reasonable attorney fees

18. Miscellaneous

Force Majeure: Neither party liable for inability to perform due to circumstances beyond control

Independent Contractor: Photographer is independent contractor, not employee

Assignment: Photographer may assign qualified substitute; Client may not assign without consent

Timeline is Estimate: Delivery timeline is estimate; Photographer not liable for delays beyond reasonable control

Weather: Outdoor shoots subject to weather conditions; reschedule if unsafe or unsuitable
