Restrictive covenants run on several clocks at once

A single separation rarely produces a single restriction. The non-compete, the non-solicit of clients, the non-solicit of employees, and any garden-leave period are usually distinct obligations, each with its own duration and its own start point. Some run from the termination date, others from the last day of garden leave, and the durations frequently differ. Treating the package as one block with one end date is how both sides get it wrong: an employer relaxes enforcement too early, or a departing employee waits longer than the law actually requires. Tracking each covenant's expiry as a separate, dated item is the only way to know exactly when each restriction lifts.

Garden leave and tolling move the real end date

Two structural features quietly shift when a non-compete actually ends. Garden leave keeps someone employed but sidelined through their notice period, and many agreements set the restriction to start only after garden leave finishes, pushing the true expiry months past the resignation. Tolling does the opposite kind of damage: if the restriction is breached, the clock pauses and the period extends by the breach's length, so a nominal end date can quietly slide later.
